(hereinafter referred to as “Organizer”)

(hereinafter “Kaiko”)

 

1. Scope

These General Terms and Conditions apply to all contracts relating to the purchase of admission tickets (“Tickets”) for the “ Hauptstadtball ” 2027, to be held on February 20, 2027, at the Konzerthaus Berlin.

Any terms and conditions of the customer that differ from or supplement these terms and conditions shall not form part of the contract unless they are expressly accepted by the organizer.

 

2. Conclusion of the Contract

The contract for the purchase of tickets is entered into between VBKI Veranstaltungsmanagement GmbH and the respective ticket purchaser.

Kaiko has been commissioned by the event organizer to handle the technical and organizational aspects of ticket sales. Kaiko acts on behalf of and in the name of the event organizer and does not itself become a contracting party with the customer.

Upon completion of the ordering process, the customer places a binding order for the selected tickets and confirms acceptance of these Terms and Conditions.

Only persons with full legal capacity are authorized to enter into a contract.

The customer is obligated to pay the agreed-upon ticket price in full. The tickets will be made available electronically or delivered in accordance with the procedure specified during the ordering process once full payment has been received.

 

3. Personalization and Transferability

Tickets for the 2027 “ Hauptstadtball ” are non-transferable.
When booking tickets, the ticket holder’s first name, last name, and date of birth are collected for personalization purposes and to facilitate the organization and execution of the event.

When booking a ball table, the booking party’s information is collected first. The information for the other table guests—specifically first name, last name, and date of birth—will be requested at a later date prior to the event. The purchaser is required to submit this guest information completely and accurately within the deadline specified by the organizer.

A ticket may be transferred to another person no later than 14 days before the event. To do so, the guest information on file must be fully updated to reflect the new person’s details within this timeframe. This includes, in particular, the first name, last name, and date of birth.

After this deadline has passed, it is no longer possible to change the ticket holder or transfer the ticket.

Changes to guest information can be made through the service channels provided by the event organizer or via the ticket hotline.

The commercial resale of tickets is not permitted.

 

4. Admission and ID Check

Admission to the " Hauptstadtball " is permitted only with a valid ticket.

An ID check will be conducted at the entrance. All guests are required to carry a valid government-issued photo ID and present it upon request.

The information provided for the event—in particular, the name and date of birth—must match the information on the identification document presented.

If a guest's identity cannot be verified beyond a doubt, or if the information provided does not match that on the identification document, the organizer may deny admission to the event.

 

5. Security Measures and House Rules

Special safety requirements apply to the 2027 " Hauptstadtball ."

The organizer is authorized to conduct reasonable security and admission checks or to have them conducted by contracted service providers.

You must follow the instructions of the event organizer, security personnel, and the staff of the Konzerthaus Berlin, provided that these instructions serve to ensure safety or the proper conduct of the event.

The organizer reserves the right to enforce house rules during the event.

Individuals who refuse to undergo security checks, significantly disrupt the event, violate the house rules, or pose a danger to themselves or others may be denied entry or removed from the event.

 

6. Table Reservations and Seating

For table reservations, the reservation includes the number of seats specified for the respective table category.

Individual seats at the pool tables cannot be reserved separately.

The organizer reserves the right to make any necessary changes to seating arrangements for production, organizational, or safety reasons, provided that such changes are reasonable for the customer.

A passenger is entitled to a specific seat only if it was expressly guaranteed during the booking process.

 

7. Prices and Payment

Prices for pool tables are listed as net prices. The applicable statutory sales tax will be added to the net price listed in each case.

Prices for Flanierkarten are listed as gross prices, including the applicable sales tax.

Any additional service, payment, or shipping fees will be displayed during the checkout process before the order is completed.

Payment is made using the payment methods offered in the ticket shop. Payment is due in accordance with the payment terms displayed during the booking process.

The customer is required to check the booking confirmation and the information contained therein for accuracy immediately upon receipt and to report any errors without delay.

 

8. Withdrawal, Cancellation, and Rescheduling

When purchasing tickets for a recreational event with a specific date, there is generally no statutory right of withdrawal under Section 312g(2)(9) of the German Civil Code (BGB).

Tickets that have already been booked cannot be canceled.
Tickets cannot be rebooked for a different ticket category.
Tickets may be transferred to another person no later than 14 days before the event, in accordance with Section 3 of these Terms and Conditions. This is subject to the required guest information being updated in a timely manner.

After this period has expired, transfer to another person is not permitted.
The customer’s statutory rights remain unaffected by this provision.

 

9. Withdrawal and Expulsion by the Organizer

In the event of a serious violation of these Terms and Conditions, the house rules, or legitimate safety instructions, the organizer is entitled, within the limits of the law, to exclude the guest from the event or to deny them admission.

This applies in particular to the tampering with tickets, unauthorized resale, intentionally false information regarding ticket holders, or any significant threat to or disruption of the event.

 

10. Dress Code

A mandatory black-tie dress code applies to the " Hauptstadtball ." For men: a tuxedo with a black bow tie.

For women: a floor-length evening gown.

The organizer reserves the right, in accordance with its right to manage the premises, to deny guests admission to the event in the event of a significant failure to comply with the mandatory dress code.

11. Meals, Menu Requests, and Allergies

For table reservations, the 3-course meal listed for the respective ticket category is included in the booked service.

For seated guests, both a standard menu and a vegetarian/vegan menu option are offered. Menu preferences will be requested separately prior to the event.

Any allergies or food intolerances must be reported within the time frame specified by the organizer.

Complete freedom from allergens or cross-contamination can only be guaranteed if expressly confirmed by the respective food service provider.

 

12. Photographs, videos, and audio recordings taken by guests

Guests are generally permitted to take private photos and videos, provided that this does not interfere with other guests, their personal rights, or the smooth running of the event.

Professional, commercial, or editorial photography, filming, or audio recording by guests or third parties requires the prior consent of the organizer.

 

13. Photography and Filming by the Organizer

During the Capital City Ball, photographs and videos will be taken by the organizer or by photographers, videographers, and, where applicable, media representatives commissioned by the organizer.

These photographs may be used, in particular, for the purposes of event documentation, press and public relations, and communications related to the Capital City Ball and the VBKI.

14. Coat Check and Personal Belongings

A free coat check is available for guests attending the Capital City Ball.

The organizer is liable for the loss, theft, or damage of clothing or other personal belongings in accordance with statutory provisions.

 

15. Liability

The organizer bears unlimited liability in cases of willful misconduct and gross negligence, as well as for damages resulting from injury to life, body, or health.

In the event of a breach of material contractual obligations due to slight negligence, liability is limited to the foreseeable damages typical for this type of contract.

Furthermore, the organizer's liability for slight negligence is excluded to the extent permitted by law.

 

16. Changes, Postponements, or Cancellations of the Event

The organizer reserves the right to make reasonable changes to the program, room assignments, or individual event components, provided that such changes do not significantly alter the overall character of the Capital City Ball.

If the event cannot be held as planned due to force majeure, an official order, or other circumstances beyond the organizer’s control, the organizer may postpone or cancel the event.

The rights of ticket holders in the event of a postponement or cancellation are governed by applicable law and the circumstances of each individual case.

 

17. Privacy Policy

Personal data is processed in accordance with applicable data protection laws.

This applies in particular to the data required for ticket booking, personalization, guest management, admission control, security coordination, and event management.

Further information regarding the purposes of processing, legal bases, recipients, retention periods, and the rights of data subjects can be found in the organizer’s privacy policy.

 

18. Accessibility

The Konzerthaus Berlin has accessible entrances and appropriate facilities.

Guests with limited mobility or other special needs are asked to contact the event organizer or the ticket hotline as early as possible so that individual arrangements for attending the event can be discussed.

 

19. Governing Law and Language of the Contract

The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. The language of the contract is German.

 

20. Place of Jurisdiction

For merchants, legal entities under public law, and special funds under public law, the place of jurisdiction is Berlin. For consumers, the statutory provisions regarding the place of jurisdiction apply.

 

21. Final Provisions

Should any provision of these General Terms and Conditions be or become invalid, in whole or in part, the validity of the remaining provisions shall remain unaffected.

Any invalid provisions shall be replaced by the applicable statutory provisions.

The version of the General Terms and Conditions that was effectively incorporated into the ticket sale at the time the respective contract was concluded shall apply.
